Rubbish Collection Barnet Terms and Conditions
These Terms and Conditions set out the basis on which Rubbish Collection Barnet provides rubbish and waste collection services to residential and commercial customers. By booking a collection with us, you agree to be bound by these Terms and Conditions. Please read them carefully before placing any booking or using our services.
1. Definitions
In these Terms and Conditions, the following expressions have the meanings set out below:
Customer means the person, business or organisation booking or receiving our rubbish collection services.
Services means the waste, junk or rubbish collection, loading, transportation, and associated services provided by Rubbish Collection Barnet.
Waste means any items, materials or substances presented by the Customer for removal, including household waste, garden waste, bulky items, furniture, appliances and commercial waste, unless prohibited by law or by these Terms and Conditions.
Contract means the agreement between the Customer and Rubbish Collection Barnet incorporating these Terms and Conditions, formed when a booking is confirmed.
2. Scope of Services
Rubbish Collection Barnet provides rubbish and waste collection services for domestic and commercial premises within our designated service area. Services typically include loading of waste onto our vehicles, transportation, and disposal or recycling at licensed facilities, in accordance with applicable waste management regulations.
The exact scope of Services for each booking, including the type and estimated volume of waste, access details, and any additional labour or time requirements, will be agreed at the time of booking and confirmed in writing or by electronic confirmation.
We reserve the right to decline any booking or refuse to collect particular items if, in our reasonable opinion, they are unsafe to handle, prohibited by law, contaminated, or not as described at the time of booking.
3. Booking Process
3.1 The Customer may request a rubbish collection by telephone, email, online request form, or other communication method offered by Rubbish Collection Barnet. The Customer must provide accurate information about the type and approximate volume of waste, the collection address, access conditions, and any special requirements.
3.2 Based on the information provided, we may offer a quote or estimated price. This quote may be subject to change if, upon arrival, the waste quantity, type or access conditions differ materially from those described.
3.3 A booking is not confirmed until we have accepted the Customer’s request and issued a booking confirmation, verbally or in writing. Once confirmed, the booking forms a Contract subject to these Terms and Conditions.
3.4 The Customer is responsible for ensuring that all details in the booking confirmation are correct. Any errors should be notified to us as soon as possible so that we can seek to amend the booking. We do not accept responsibility for losses or delays arising from incorrect or incomplete information provided by the Customer.
4. Access and Customer Responsibilities
4.1 The Customer must ensure that our collection team has safe and reasonable access to the waste at the agreed time. This includes arranging parking or entry permits where necessary and providing any access codes or keys required in advance.
4.2 All waste intended for removal should be clearly identified and separated from items not to be taken. The Customer must ensure there is no ambiguity as to which items are to be collected.
4.3 The Customer must not present for collection any waste that is dangerous, hazardous, explosive, highly flammable, or otherwise prohibited by law or by these Terms and Conditions, unless previously agreed in writing and in compliance with all regulatory requirements.
4.4 If our collection team reasonably deems the access unsafe or the working conditions hazardous, or if they are unable to gain access within a reasonable time of arrival, we may cancel or postpone the collection and a call-out or cancellation fee may apply.
5. Waste Types and Prohibited Items
5.1 We can collect most general household and commercial rubbish, bulky items, garden waste and non-hazardous materials, subject to space and weight limits on our vehicles.
5.2 Certain items may be restricted, require special handling or incur additional charges, including but not limited to electrical items, mattresses, tyres, fridges and freezers, paint, plasterboard and certain construction waste. The Customer should notify us of any such items at the time of booking.
5.3 We do not normally collect hazardous or specialist wastes such as asbestos, clinical or medical waste, radioactive materials, solvents, chemicals, gas bottles, ammunition or any waste classified as hazardous under applicable legislation, unless expressly agreed in advance and subject to additional conditions and charges.
5.4 If prohibited or undeclared hazardous items are found within the waste on arrival, we may refuse to collect them, adjust the price, or cancel the booking. The Customer may be liable for any additional costs or regulatory consequences arising from such items being presented.
6. Pricing and Quotes
6.1 Prices are generally based on the volume and type of waste, labour required, and the time spent on site. We may also take into account access conditions, parking charges, disposal fees and any relevant regulatory costs.
6.2 Any quote or price estimate given before arrival is based on the information supplied by the Customer and is not binding if the waste or access conditions differ materially. The final price will be confirmed on site before work begins. If the Customer does not agree to the revised price, we will not proceed with the collection and a call-out fee may apply.
6.3 All prices are quoted in pounds sterling and may be subject to applicable taxes or statutory charges. We reserve the right to adjust our pricing structure from time to time.
7. Payments
7.1 Payment is due on completion of the collection unless otherwise agreed in writing. We may require payment in advance or a deposit for certain bookings, larger loads or commercial accounts.
7.2 We accept the payment methods notified on our invoices or booking confirmations, which may include cash, debit or credit card, or bank transfer. Commercial customers may be offered account terms subject to approval and credit checks.
7.3 If payment is not made when due, we reserve the right to charge interest on overdue amounts at the statutory rate and to recover all reasonable costs incurred in pursuing payment, including legal and debt recovery fees.
7.4 Title to any waste removed from the Customer passes to Rubbish Collection Barnet only when full payment has been received, subject to applicable waste legislation. Until then, we may retain or return waste where legally permissible.
8. Cancellations and Amendments
8.1 The Customer may cancel or reschedule a booking by contacting us directly. Where possible, we request at least 24 hours notice before the scheduled collection time.
8.2 If the Customer cancels a booking with less than 24 hours notice, or fails to provide access at the agreed time, we may charge a late cancellation or call-out fee to cover our costs.
8.3 We will make reasonable efforts to accommodate any amendments requested by the Customer, such as changes in collection time, address or waste volume. If such changes materially affect the price or feasibility of the booking, a revised quote will be provided.
8.4 In rare circumstances, such as operational issues, vehicle breakdown, staff illness, severe weather or other events beyond our reasonable control, we may need to cancel or postpone a booking. In such cases, we will notify the Customer as soon as reasonably practicable and, where possible, offer an alternative collection date. We shall not be liable for any consequential loss arising from such cancellations or delays.
9. Performance of the Services
9.1 We will carry out the Services with reasonable care and skill and in compliance with applicable waste management and environmental regulations.
9.2 We will use reasonable endeavours to attend at the agreed time, but timing is not guaranteed and may be affected by traffic, weather, access issues or other operational factors. If we anticipate a significant delay, we will, where practicable, inform the Customer.
9.3 Our collection team will take reasonable care when removing waste from the premises. However, the Customer should protect any fragile or valuable items and ensure clear access routes. We are not responsible for pre-existing damage or for wear and tear that may reasonably occur when large or heavy items are removed through confined spaces.
10. Liability and Limitations
10.1 Nothing in these Terms and Conditions limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability which cannot be limited or excluded under applicable law.
10.2 Subject to the above, our total liability to the Customer arising out of or in connection with any single booking, whether in contract, tort or otherwise, shall not exceed the total price paid or payable for that booking.
10.3 We shall not be liable for any indirect, consequential or special loss, or for any loss of profits, revenue, business, contracts, or anticipated savings arising out of or in connection with the Services.
10.4 The Customer is responsible for ensuring that they have the authority to dispose of all items presented for removal. We accept no liability for removing items that were mistakenly presented for collection by the Customer or by persons acting on their behalf.
10.5 The Customer shall indemnify and keep indemnified Rubbish Collection Barnet against any claims, losses, damages, costs or expenses arising from: any breach by the Customer of these Terms and Conditions; any presentation of hazardous or prohibited waste; or any lack of authority to dispose of items.
11. Compliance with Waste Regulations
11.1 Rubbish Collection Barnet will handle, transport and dispose of waste in accordance with applicable UK waste, environmental and duty of care regulations. We will use licensed waste transfer and disposal facilities and will, where practicable, seek to recycle or recover materials.
11.2 The Customer must cooperate with us to ensure legal compliance, including providing accurate information about the nature and source of the waste. Where required, waste transfer notes or other documentation will be completed to record the movement of waste.
11.3 The Customer must not ask or require us to dispose of waste unlawfully, to fly-tip waste, or to breach any environmental regulations. We reserve the right to refuse Services in any situation where we consider that legal or regulatory standards may be compromised.
12. Data Protection and Privacy
12.1 We collect and process personal data about Customers in order to provide our Services, manage bookings, handle payments, and comply with legal obligations. Personal data may include names, contact details, addresses, payment information and booking history.
12.2 We will handle personal data in accordance with applicable data protection laws in the United Kingdom. We will take reasonable technical and organisational measures to protect personal data from unauthorised access, loss or misuse.
12.3 We may use Customer contact details to provide service updates or relevant information about our rubbish collection services. Customers may opt out of non-essential communications at any time by contacting us.
13. Complaints and Dispute Resolution
13.1 If the Customer has any concerns or complaints about our Services, they should contact us as soon as possible, providing full details of the issue and any supporting information.
13.2 We will investigate complaints in a fair and timely manner and aim to resolve any issues promptly. Where appropriate, we may offer to revisit the site, adjust charges, or take other remedial steps.
13.3 If a dispute cannot be resolved directly, both parties agree to consider negotiation or mediation as a means of resolving the matter before taking legal action, where this is appropriate and proportionate.
14. Amendments to these Terms
14.1 We may update or amend these Terms and Conditions from time to time to reflect changes in law, regulation, industry practice or our service offerings.
14.2 The version of the Terms and Conditions in force at the time of booking will apply to that booking, unless changes are required by law or regulatory authority.
15. Severability
15.1 If any provision of these Terms and Conditions is held by a court or competent authority to be invalid, unlawful or unenforceable, that provision shall be removed or limited to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.
16. Governing Law and Jurisdiction
16.1 These Terms and Conditions and any disputes or claims arising out of or in connection with them or with any Services provided by Rubbish Collection Barnet shall be governed by and construed in accordance with the laws of England and Wales.
16.2 The courts of England and Wales shall have exclusive jurisdiction to settle any disputes or claims arising out of or in connection with these Terms and Conditions or their subject matter.
By making a booking or using the Services of Rubbish Collection Barnet, the Customer confirms that they have read, understood and agree to be bound by these Terms and Conditions.
